Mediation is usually assigned by a judge or magistrate when both parties are not in agreement. This may be ordered in a civil or family case. A Mediator could be assigned by the Court or chosen by the parties. There is usually a cost assessed for a Mediator and the cost may be shared by both parties. Mediation may be required before a hearing is set. During mediation, both parties can discuss issues with the help and direction from the certified Mediator. Mediation can last a few hours up to months until both parties are able to agree and/or settle. The Mediator finishes with a written report of the decisions and then it is sent to the judge.
